New York City police officers shot a gunman who was involved in a shootout in Brooklyn on Tuesday, authorities say.

The second gunman remains at large, police said at a press conference.

It happened near Ocean and Church avenues in Flatbush at around 7:30 p.m.

Eric Echeemponj, who works at a laundromat nearby, showed CBS News New York a surveillance video that shows a heated argument going on off camera. Gunshots ring out shortly after.

"I thought somebody was breaking my door, my rear door. Everyone was screaming," Echeemponj said.

NYPD Assistant Chief Francis Giordano said officers patrolling in a vehicle in the area heard the shots and encountered two individuals involved in a shootout.

The officers got out of their vehicle and fired several shots at the gunman who was closest to them, Giordano said. The individual was struck at least once.

Police said the suspect was taken to a local hospital and was initially listed in critical condition. He later improved to stable.

Giordano said a handgun was recovered at the scene, as well as multiple shell casings.

The shooting was caught on body cameras, police said.

The officers were not injured, but were taken to a local hospital to be checked out.

The second gunman fled the scene and has not yet been caught, according to police.

Gunman had been arrested twice, was out on parole, police say

Police blamed the criminal justice system for allowing the shooting to happen. They said the suspect that officers shot was a two-time convicted felon who should have received a lengthier prison sentence for his prior crimes.

Police identified that man as 22-year-old Edynesson Bauduy, who was out on parole.

Giordano said Bauduy was arrested for shooting someone in 2021. He was released while that case was pending, then was arrested again for a violent commercial robbery in southern Brooklyn, police said.

Bauduy pled guilty to both crimes and received a concurrent sentence, according to Giordano.

Police said Bauduy had just been released from prison on June 10 of this year.

"This is a person who has repeatedly shrugged his shoulders at consequences and at our criminal justice system for these violent crimes that he committed," Giordano said. "Once again, our officers confronted a dangerous situation."

Giordano said Bauduy was 18 years old at the time of his first arrest and will be on parole until 2030.
