WALNUT CREEK — Highly enhanced video from body cameras worn by Walnut Creek police officers appears to depict how one of them fatally shot a man armed with a BB gun just five seconds after the officer got out of his cruiser and confronted him.The Walnut Creek Police Department on Thursday afternoon released snippets of body camera footage from the two officers who confronted 46-year-old Joaquin “Tony” Pereyra on Feb. 26. One of the officers fired. Pereyra died at the scene.The two officers responded to the 2500 block of Overlook Drive just after midnight after reports that a man in dark clothing was looking into homes and parked vehicles with a flashlight. Officers located Pereyra at Alvarado Avenue and Buena Vista Avenue.According to police, Lee reported that Pereyra had a gun. After the shooting, police determined that it was a black BB pistol. They showed the gun as part of the publicly released video package.Video from Lee’s camera shows Lee ordering Pereyra to the ground and to show his hands. That video next shows Pereyra walking around Lee’s patrol vehicle as Michels’ vehicle arrives, when Lee appears to lose sight of the man.In a statement, spokesperson Lt. Drew Olson identified the two officers as Corp. Nick Michels and Officer Mike Lee. Both have returned to active duty.“This remains a tragic incident for everyone involved,” Walnut Creek Police Chief Ryan Hibbs said in a statement. “Releasing this footage is an important step in providing transparency to our community. While the video footage shows part of what occurred, the full review includes additional evidence and analysis that are being examined through the investigative process.”
