Authorities say Brandon Thompson, 30, shot Kay Smith, 31, in the back of the head as he fired at a police officer.

A woman critically injured in a shootout early Wednesday near Zilker Park has been identified as 31-year-old Kay Smith, according to arrest warrants for the suspected gunman.

Police say Brandon Thompson, 30, shot Smith in the back of the head while firing at Senior Austin police officer Adam Reinhart. Reinhart encountered Thompson and Smith around 4 a.m. Wednesday while assisting with the repossession of a reported stolen vehicle. Thompson is now charged with attempted capital murder of a peace officer.

Police have not provided an update on Smith’s condition. But according to the warrant, a nurse at Dell Seton Medical Center declared her “brain dead” Wednesday afternoon and said her injuries were “non-compatible with life.”

In the warrant, officers describe the last listed residence of Smith and Thompson as "transient." The document also indicates that Smith and Thompson were in a relationship.

Thompson has been in custody at a local hospital after being shot by an armed homeowner, according to police. He faces two first-degree felony charges: attempted capital murder of a peace officer and burglary of a residence.

According to law enforcement sources, Thompson cannot be charged for shooting Smith until she is pronounced dead.

The warrants also provide detailed accounts of what police say happened Wednesday morning.

According to the documents, two Austin officers observed an unattended vehicle at 3:31 a.m. on Zilker Park grounds and initiated a repossession of the vehicle after a license plate scan revealed the plates belonged to a different vehicle that had been reported stolen.

About 30 minutes later, Reinhart saw a man and woman – believed to be Thompson and Smith – emerge from a wooded area near where the unattended vehicle was located. Reinhart engaged with the man and woman as they walked away down a trail into the wooded area.

Reinhart told the man and woman they were being detained after they acknowledged the unattended vehicle was theirs, at which point the woman began walking toward the officer while the man “appeared to linger back,” according to the arrest warrants.

As Reinhart directed the man to take his hand out of his pocket, the man drew a firearm and “fired multiple shots in the direction of Reinhart,” striking the woman in the head and the officer in the abdomen.

The man then fled on foot, initiating a three-hour manhunt that overtook nearby neighborhoods and concluded when a Barton Hills homeowner shot Thompson after he broke into a residence.

According to the warrants, police sent an emergency text alert to roughly 100,000 phone numbers in a 2.2 mile radius of the shooting through Warn Central Texas, an emergency alert platform utilized by local public safety agencies.

Thompson has been charged with attempted capital murder of a peace officer and burglary of a residence, both first-degree felonies, police said. According to Travis County jail records, Thompson’s bail has been set at $500,000 for the capital murder charge and $100,000 for the burglary charge.
