The suspect who was shot, 35-year-old Hernan Gutierrez, will be charged with aggravated assault on a public servant, police said. He was also wanted on a federal probation violation for a firearm-related offense.Police said Senior Cpl. Matthew McLain was told by property management at 1910 Bennett Ave. that a man they believed to be involved in a stolen vehicle case earlier this month where the suspect rammed a police car was at the location. McLain requested back up when he got to the apartments, police said, and when more officers arrived, McLain and Officer Kimberley Esquivel walked through the building and found Gutierrez in the back parking lot.Police said McLain began giving commands to Gutierrez but the suspect puled away and began struggling with the officers.According to police, the suspect became "uncooperative."Police said there was some sort of struggle that occurred between the officers and Gutierrez that led officers to deploy a taser, but the taser "was not effective."During the encounter, police said Gutierrez pulled out a handgun and fired one round. Esquivel then reportedly shot the suspect in the torso.The suspect was transported to a hospital in critical condition, according to police.The officers involved were not injured.
