Warwick police have released body cam footage of the incident that led to a misdemeanor assault charge against a sergeant.

Sgt. Britton Kelly,55, was charged July 27 with simple assault after investigators said Kelly kicked a man in handcuffs in the head during a police response July 15.

The video released Tuesday shows the suspect, Ryan York, handcuffed in the back of a police cruiser after he was in involved in a domestic incident on Amsterdam Avenue with a woman, according to police.

In the video, York can be heard saying he “doesn’t feel good” and can be seen leaning out of the cruiser to dry heave.

Kelly is seen approaching York and appears to strike York in the head with a kick.

“What did you just punch me in the head for?” York is yelling.

“Because you hit my officer,” responded Kelly.

From there, Kelly takes York out of the vehicle and puts him on the ground when the video cuts out.

Kelly is on administrative leave from the department and his next court appearance is scheduled for Aug. 10.

“It is critical to note that Sgt Kelly had responded to a domestic violence call where an officer had been assaulted by a witness,” said Kelly’s attorney Edward Roy.

“Officers responding to domestic violence incidents are more likely to suffer injuries than almost any other type of call. We need to be cognizant of the potential dangers present in these types of cases. We need to resist judging Sgt. Kelly solely on the body camera videos alone,” Roy added.
