Officials from the Bakersfield Police Department released footage of an officer-involved shooting from August 15 on Aquamarine Peak Way, south of McCutchen Road, that ended with a man tased multiple times, but not shot.

Home security video shows 35-year-old Martiano Jimenez throwing items at a truck in a driveway. Jimenez was captured taking home decorations and plants, while trying to damage the truck of a person he did not know, according to police.

Officers responded to the area around 5:20 a.m. for a report of a man trying to break into a home, which is captured by officer-worn body cameras.

Upon arrival, officers contacted Jimenez. He is seen on camera seemingly uncooperative and hostile with officers. He was armed with a rock when they contacted him, according to police. Jimenez was captured twice throwing what appears to be rocks at an officer.

Officer J. Nogueda was involved in the incident and is seen in the footage as he fired a shot at the ground near Jimenez, seemingly to back him up, as he ignored orders.

Officers used a Tazer three times to stop Jimenez; the first two shots did not affect him, according to police.

Officer Nogueda has been with the department for about a year, said BPD.

"The public has a legitimate interest in obtaining timely and accurate information about police shootings, and the Bakersfield Police Department is committed to making that information available," Chief of Police, Greg Terry said. "We will release the body worn camera footage of officers in critical incidents as soon as it is possible to do so without compromising an investigation. This is our commitment to accountability and professionalism.”

Jimenez was taken to a hospital for treatment, then subsequently arrested. He is currently charged with assault with a deadly weapon on a peace officer, obstruction or resisting of an executive officer and vandalism of $400 or more.
