When Alvin Motley Jr. was fatally shot, he appeared to be raising his right hand towards his mouth, likely to take a drag from the lit cigarette in his hand, according to Memphis police homicide detective Sgt. LaTanya West.West was one of three witnesses who testified in the preliminary hearing of Gregory Livingston, a contracted security guard whose case is now headed toward a grand jury in Shelby County. Livingston is accused of fatally shooting Motley over an argument about loud music.Surveillance and bystander cellphone videos of the shooting were also shown in Shelby County court Tuesday, shedding light on the events surrounding the fatal shooting of Motley at a Kroger gas station in East Memphis on Aug. 7.General Sessions Judge Louis Montesi, who had previously blocked the release of the video, upheld the defense's request that copies of the videos not be distributed to the public but the local news pool was able to record footage played for the court.
