I was working a one man patrol unit around 8 pm, when I saw a van weaving all over the road. We were in the middle of a rash of DUI related crashes, mostly involving our undocumented Hispanic friends. This looked like a chance to get a dangerous drunk off the streets and in a bus back to Mexico.
I walked up to the driver side of the van. could only see the top of his head and his hands on the steering wheel. The driver was a short Hispanic kid, about 13 years old. His passenger was his sister.
She was about 10 years old and dressed in a Catholic School Uniform. "Do you have a driver's license?" The kid looks at me, sneers and says: "NO, I am only 12, do I look like I have a driver's license?" Rather than yanking him out the window and slamming him on the concrete, I stood he and his sister on the sidewalk.
The kid tells me that his father said it was OK for him to go and pick his sister up at a school event and gave him $10 to buy MacDonald's on the way home. I towed the van and tossed Junior and Sis
in the back of my patrol car and headed for a visit with Dad. I kept the kids in my car and pounded on the door to their house. Dad answered the door. I told him the story and asked him if he let Junior drive his van. He didn't ask about his kids, but got super pissed when I told him the van had been towed. Dad was on the verge of getting pepper sprayed, when I asked him if he knew what he did was illegal and dangerous. Yeah, so what?
I wrote Dad a fat ticket for allowing an unlicensed driver to operate a motor vehicle. I wrote the kid a stack of tickets for unlicensed driver, seat belt violation, unsafe lane change and a few other things. When I had the kid and Dad sign their tickets, Dad TOLD me to return his van to his driveway or he would sue me. I smiled sweetly and encouraged him to find a lawyer that would take his money.
The next day, I was walking through the station to get ready to work. The HISPANIC Watch Commander was sitting in his office, talking to dear old Dad. The W/C motioned me into the office.
Dad pointed at me and said: "That's the mother-fucker, right there." He was demanding the release of his unregistered, uninsured van from the tow yard and wanted the tow fees waived! It WAS, at the time, illegal to release a vehicle without up to date registration and proof of insurance. With a smile on his face, Lt. Hernandez violated California law and released the Van.
Several months later,I got a call from a co-worker. "Did you hear what happened to Hernandez?" "He beat the shit out of his wife, got chased by Long Beach PD and when he crashed, he fought the cops and was DUI." This was the beginning of catering to Hispanics in California. Each and ever charge was dropped, but the city MADE HIM RETIRE. Some stupid white cop would have done some serious prison time for doing the same thing.
That is messed up man
It's too bad the kid didn't run over someone so dad could be still rotting in prison.
